The Mato Grosso Soybean and Corn Producers Association (Aprosoja MT) celebrates the formation of an absolute majority in the Supreme Federal Court (STF) in the judgment of Direct Action of Unconstitutionality (ADI) 7.774, upholding the constitutionality of Law No. 12.709/2024, which prohibits the granting of state tax incentives to companies that adhere to the illegal pact called the "Soybean Moratorium".
The Supreme Court's decision is an important milestone in recognizing the validity of the law approved by the State of Mato Grosso and reaffirming that the Soy Moratorium is an illegal, exclusionary instrument that violates the principles of free competition and equality among producers, in disregard of the Brazilian Forest Code. Aprosoja MT presented to the Supreme Court a legal opinion from the Portuguese professor, Dr. Carlos Blanco de Morais.
In his vote, Minister Dias Toffoli highlighted the harmful effects of the private agreement: “In the case of the Soy Moratorium, its practical consequence is to subject medium, small, and micro-soy producers to the impositions established therein.” He concluded: “The agreement has significantly and negatively impacted agricultural work and the livelihoods of a myriad of medium, small, and micro-rural producers, as well as local and regional communities and economies, among other aspects.”
The understanding reached by the vast majority of the Supreme Federal Court reinforces the importance of guaranteeing legal certainty and equal conditions for all rural producers, without interference from illegal private mechanisms that restrict the market and disrespect Brazilian environmental and competition law.
Aprosoja MT also points out that the Administrative Council for Economic Defense (CADE) has already recognized the effectiveness of the preventive measures taken by the General Superintendence and suspended the Soy Moratorium as of January 2026, precisely because it identified evidence of a violation of economic order.
Thus, the Supreme Court and CADE, in full harmony, reinforce our National Sovereignty and the correct application of Brazilian legislation, guaranteeing legality, fair competition, and freedom of production in the Brazilian countryside.
